Hellow Terms of Use

Version: 1 (draft, updated 2026-10-15 for paid plans, D038, and Hellow booking, D039) · Effective date: [[PLACEHOLDER: EFFECTIVE_DATE]] · Status: DRAFT, not yet reviewed by a lawyer

Placeholders look like [[PLACEHOLDER: ...]] and points that need a lawyer look like [[LAWYER REVIEW: ...]]. The full list is in docs/legal/README.md.

These terms are an agreement between you and [[PLACEHOLDER: COMPANY_LEGAL_NAME]], [[PLACEHOLDER: COMPANY_REGISTERED_ADDRESS]] ("Hellow", "we", "us"). They apply to the Hellow app and to Hellow web pages, including the page a person sees when they open a Hellow link. Our Privacy Policy explains how we handle personal data.

1. Who can use Hellow

  • Sharers create an account in the app. You must be at least 16 and able to enter into this agreement. If you use Hellow for an employer or client, you confirm you are allowed to.
  • Receivers open a Hellow link in a browser. You do not need an account. Sections 4, 5, 9 and 11 to 14 apply to you when you use the receiver page.

2. The service

Hellow lets you share a digital contact card (by NFC tap on supported Android phones, the system share sheet including AirDrop, or a QR code), lets people you meet leave their contact details back with their consent, and helps you remember and follow up with them.

  • Plans. Hellow has a Free plan and a paid Pro plan (section 2a). While Hellow is in beta your account may have Pro features at no charge. We will tell you in the app before that ends, and you will never be charged without agreeing to it first.
  • Third-party apps. Follow-ups open WhatsApp, your email app, or LinkedIn. Hellow does not send messages itself. Those services have their own terms.
  • Availability. NFC tap sharing depends on device hardware and settings and does not work on every phone. A QR code is always available. We may change, suspend, or stop features, and will give reasonable notice of material changes where we can.

2a. Pro subscription

[[LAWYER REVIEW: this whole section. Draft for D038: consumer information duties for a digital subscription, who the seller is, the withdrawal wording, price changes and VAT.]]

  • Plans. Free: your profile, all sharing, saving contacts and capture; the newest 25 contacts are visible. Pro: all contacts, notes, reminders, follow-up templates, statistics, export, and Hellow booking with Google Calendar. Capture never stops on Free: the details people leave are always saved, only what you can see is limited. Nothing is deleted when Pro ends, and upgrading shows everything again.
  • Price. 4 EUR a month or 36 EUR a year [[PLACEHOLDER: PRICES_INCLUDING_VAT, confirm the prices and that VAT is included]]. The price shown in Google Play before you buy is the price you pay. If we change the price, we tell you in advance, and Google Play asks for your agreement where it requires it.
  • Buying and paying. You buy Pro in the app through Google Play. Google Play takes the payment under Google Play's terms. Seller: [[PLACEHOLDER: SELLER_OF_RECORD, Google Play or Hellow]].
  • Automatic renewal. The subscription renews automatically at the end of each month or year, at the price in force, until you cancel. Google Play charges you at renewal.
  • Cancelling. Cancel at any time in Google Play (Subscriptions, then Hellow, then Cancel), or from Manage subscription in the app, which opens Google Play. Cancellation takes effect at the end of the period you already paid for, and you keep Pro until then. We do not refund the part of a period already started, except where the law or Google Play's refund rules say otherwise.
  • Right of withdrawal (EU consumers). If you are a consumer, you have the right to withdraw from the purchase within 14 days without giving a reason. If you ask us to start Pro right away, you agree that Pro begins during the 14 days. If you withdraw after that, you pay an amount proportionate to what you have used until you told us. When the service has been fully provided and you gave your express consent and acknowledged that you lose the right of withdrawal, the right ends. To withdraw, use Google Play's refund option or write to [[PLACEHOLDER: SUPPORT_CONTACT_EMAIL]].
  • Our wording before you pay. In the app, before the Buy button, the purchase page shows: "I want Pro to start now. I understand that I lose my 14-day right of withdrawal once Pro has been fully provided, and that if I withdraw earlier I pay for what I have used." You confirm it with a tick. [[LAWYER REVIEW: exact wording, and whether the tick is required by Directive 2011/83/EU Art. 16 and Romanian OUG 34/2014 for a purchase through Google Play; the matching paywall change is for a later task.]]
  • If payment fails or Pro ends. You return to the Free plan. We do not delete your data for that reason.
  • Hellow booking. Booking needs Pro, a connected Google Calendar and booking turned on. You are responsible for the meetings you accept and for keeping your calendar correct. When you connect Google Calendar, Hellow uses your Google data only as set out in the Privacy Policy, section 3b. You can disconnect at any time.

3. Your account

You are responsible for activity on your account and for keeping access to your sign-in email or Google account secure. Tell us at [[PLACEHOLDER: SUPPORT_CONTACT_EMAIL]] if you think someone else has accessed it. You can export your data or delete your account at any time in Settings.

4. Acceptable use

You must not use Hellow to:

  • impersonate another person or company, or create a profile with false identity information;
  • collect people's details without their consent, scrape profiles, guess or enumerate share links, or build contact lists for resale;
  • send spam, or send marketing that breaks anti-spam or e-privacy law (receiving someone's contact through Hellow is not consent to marketing);
  • harass, threaten, or discriminate against anyone;
  • upload unlawful content, malware, or content that infringes others' rights;
  • probe, overload, or bypass the security of Hellow, including rate limits and bot checks, except through a responsible disclosure to [[PLACEHOLDER: SECURITY_CONTACT_EMAIL]];
  • make NFC or other sharing behave like a payment card or another app's tag.

We may remove content, revoke share links, or suspend accounts that break these rules (section 10).

5. Contacts you receive

When someone leaves their details for you, they chose which fields to share and for what purpose. You agree to:

  • use their details only for the purpose they were shared for, such as following up on your meeting;
  • respect deletion: if they delete what they shared, it disappears from your Hellow inbox;
  • comply with data protection law for any copies you make outside Hellow, for example in your phone contacts or a CRM. [[LAWYER REVIEW: align this with the controller roles in the Privacy Policy, section 1.]]

6. Your content

You keep ownership of what you add to Hellow (your profile, photo, notes). You give us a limited, non-exclusive licence to host, store, and display it only as needed to run Hellow for you: for example, showing your public profile fields to the people you share your link with. This licence ends when you delete the content or your account, apart from backup copies that expire as described in the Privacy Policy.

You confirm you have the right to use the content you upload. Notes are private to you.

7. Our software and brand

Hellow, its software, design, and brand belong to us or our licensors. We give you a personal, non-transferable, revocable licence to use the app for its intended purpose. You must not copy, resell, or reverse engineer it except where the law allows.

8. Feedback

If you send ideas or feedback, we may use them without any obligation to you.

9. Reporting fake or abusive profiles

Every receiver page has a "Report this profile" link. We review reports and may revoke links or suspend accounts. You can also write to [[PLACEHOLDER: SUPPORT_CONTACT_EMAIL]].

10. Suspension and ending

You can stop using Hellow and delete your account at any time. We may suspend or end your access, or revoke share links, if you seriously or repeatedly break these terms, if the law requires it, or to protect other people or the service. Where reasonable, we will tell you why and give you a chance to respond. [[LAWYER REVIEW: confirm notice requirements under EU Regulation 2019/1150 (P2B) and the Digital Services Act for a service of this size.]]

11. Disclaimers

Hellow is provided "as is" during the beta. We work to keep it available and secure, but we do not promise it will be uninterrupted or error-free, that every NFC tap will be read, or that every follow-up reminder will be delivered (reminders depend on your phone's notification settings). Nothing in these terms limits rights you have as a consumer under mandatory law.

12. Liability

[[LAWYER REVIEW: liability clause. Draft intent: we are liable without limit for intent, gross negligence, and death or personal injury; for other cases our total liability is capped at [[PLACEHOLDER: LIABILITY_CAP, e.g. EUR 100]] while Hellow is free; no liability for indirect or consequential loss to the extent the law allows. Consumer protections under Romanian and EU law must remain untouched.]]

13. Changes to these terms

We may update these terms. We will publish the new version with a new version number and effective date, and tell sharers in the app at least [[PLACEHOLDER: NOTICE_PERIOD_DAYS, e.g. 30]] days before material changes take effect. If you do not agree, you can delete your account before then.

14. Law and disputes

These terms are governed by [[PLACEHOLDER: GOVERNING_LAW, e.g. Romanian law]]. Courts in [[PLACEHOLDER: JURISDICTION, e.g. Cluj-Napoca, Romania]] have jurisdiction, but if you are a consumer you may also bring claims in the courts where you live, and you keep the protection of the mandatory laws of your country of residence. Consumers can also use the Romanian ANPC alternative dispute resolution entities. [[LAWYER REVIEW: confirm the ADR / SAL references required for Romanian consumers.]]
